1. AGREEMENT TO TERMS

By downloading or playing Cheddar Dash, you agree to these Terms. The Game is owned and operated by Borja Rodríguez Burgos (hereinafter referred to as "The Developer"). If you do not agree, please do not use the application.

© 2. INTELLECTUAL PROPERTY & OWNERSHIP

The Developer retains exclusive ownership of all rights, title, and interest in The Game, including but not limited to source code, pixel art graphics, animations, character designs, interface, sound effects, and musical compositions. You acknowledge that you have no ownership rights in the App. Unauthorized copying, reverse engineering, modification, or distribution of these assets is strictly prohibited and violates International Copyright Laws.

3. LIMITED LICENSE

We grant you a personal, non-exclusive, non-transferable, revocable license to use The Game for your personal, non-commercial entertainment on a mobile device. You may not sell, rent, or sublicense the Game.

🔐 4. ACCOUNT & SECURITY (GOOGLE AUTH)

To ensure maximum security, we do not store user passwords on our servers. We utilize secure third-party authentication services (Google Sign-In and Apple Sign-In) to validate your identity. A unique User ID (UID) is processed solely to link your account and enable Cloud Save to sync your progress (levels, skins, currency) across devices. We do not sell your personal data. You may delete your account at any time directly from the in-game Settings menu. Deletion is immediate and irreversible: all progress, skins, virtual currency, and lives are permanently removed with no possibility of recovery or refund for virtual goods lost.

💎 5. VIRTUAL GOODS & REFUNDS

Game currency ("Rubies") can be used to acquire virtual items ("Skins") and extra lives within the game. These constitute a limited license to use in-game features. They are not personal property and have no monetary value in the real world.

REFUND POLICY: All purchases are generally final. However, as a courtesy, we may offer a refund for Rubies purchased via Google Play within 48 hours of the transaction, PROVIDED THEY HAVE NOT BEEN SPENT/USED. Once the virtual currency is used, the transaction is irreversible.

* NOTE: For iOS users, all refund requests are handled exclusively by Apple via the App Store; The Developer cannot process these manually.

📢 6. ADVERTISEMENTS & DATA

This application integrates Google AdMob to serve advertisements. Depending on your region and your choices, ads may be personalized or non-personalized. In certain regions, you will be shown a consent message to choose your ad preferences, and you can change your choice at any time in the app settings.

⚠️ 7. HEALTH WARNING (EPILEPSY)

The Game contains flashing lights, rapid movements, and pixel art patterns that may trigger seizures in people with photosensitive epilepsy. Player discretion is advised. If you experience dizziness, altered vision, or muscle twitches, stop playing immediately and consult a doctor.

8. USER CONDUCT & CHEATING

You agree not to use automation software (bots), hacks, mods, or any unauthorized third-party software to modify or automate the Game. The Developer reserves the right to ban accounts found exploiting bugs or cheating, without refund.

9. DISCLAIMER & LIABILITY

The Game is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the fullest extent permitted by law, The Developer shall not be liable for any damages (including lost data, device damage, or financial loss) arising from the use or inability to use the Game.

11. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of Spain. Any legal suit, action, or proceeding arising out of these Terms shall be instituted in the competent courts of Spain.

12. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. For non-material changes (corrections, updated contact details), the updated Terms will be posted with a new "Last Updated" date. For material changes affecting your data processing or rights, you will be notified via an in-app message at your next login. If you do not accept material changes, you may delete your account before they take effect.

13. CHILDREN'S PRIVACY

This Game is intended for a general audience, including children. At first launch, the app asks users whether they are a minor. If you indicate you are under the applicable digital consent age (13 in the USA; 14 in Spain and most of the EU), personalized advertising is automatically disabled and only generic, non-personalized ads are served for that and all future sessions. Users of legal age may review and update their advertising consent at any time from the lateral in-game menu under "Consent." We do not knowingly collect personal data from minors beyond what is strictly necessary. Parents or guardians who believe their child has provided personal information may contact support@cheddardash.com for immediate deletion.

14. Data Retention

We retain your data for as long as you maintain an account in the Game. You may delete your account at any time from the in-game Settings menu. Deletion is immediate and irreversible: all associated data (UID, progress, purchases) is permanently erased. We will not retain data beyond what is necessary for the purposes described in these Terms.

🛡️ 15. Rights under GDPR and Spanish Data Protection Law

If you are a resident of the European Economic Area (EEA), United Kingdom, or Switzerland, you have the right to: access, rectify, erase, restrict, or port your personal data; object to processing based on legitimate interests; and withdraw consent at any time without affecting the lawfulness of prior processing. To exercise these rights, contact us at support@cheddardash.com. If you are in Spain, you may also lodge a complaint with the Agencia Española de Protección de Datos (AEPD) at www.aepd.es.

🇪🇺 16. Digital Services Act (DSA) — EU Compliance

In accordance with Regulation (EU) 2022/2065 (Digital Services Act), the responsible party for this application is: Borja Rodríguez Burgos, C/Mejorana nº 2, C.P: 41006, Sevilla, España. Contact: support@cheddardash.com. We do not use algorithmic recommender systems based on profiling within the meaning of the DSA. Any advertising displayed identifies the advertiser and the parameters used for targeting. Users may always opt out of personalised advertising from the app's Consent menu.

🇺🇸 17. California Consumer Privacy Rights (CCPA/CPRA)

If you are a California resident, you have the right to: (1) know what personal information we collect about you and how it is used and shared; (2) delete personal information we have collected, subject to certain exceptions; (3) opt out of the "sale" or "sharing" of your personal information — we do not sell or share personal data for cross-context behavioural advertising as defined by the CPRA; (4) non-discrimination for exercising your privacy rights. 🌐 18. International Data Transfers

Cheddar Dash uses Firebase (Google LLC) services — including Firestore, Analytics, and Crashlytics — to operate the Game. Data may be transferred to and processed on servers located in the United States and other countries. For users in the EEA, UK, or Switzerland, such transfers are covered by Standard Contractual Clauses (SCCs) approved by the European Commission. For users in China (PRC), data is processed in accordance with the Personal Information Protection Law (PIPL); by using this Game you acknowledge the cross-border transfer of your UID and game data to Google servers, as necessary to operate the service. For users in India, processing is conducted in accordance with the Digital Personal Data Protection Act 2023 (DPDP Act). For users in Australia, we comply with the Australian Privacy Act 1988 and the Australian Privacy Principles (APPs). 10. PRIVACY DETAILS (SUMMARY)

Below is a short, practical summary of the data we process and why:

Account & Cloud Save

Email address and UID (Google Sign-In) to link your account and sync game progress across devices.

Game Data

Progress and gameplay data (levels, skins, currency, rankings) stored in Firebase/Firestore to provide core features.

Analytics

Firebase Analytics to understand usage and improve gameplay and balance.

Crash Reports

Firebase Crashlytics to diagnose crashes and improve stability/performance.

Advertising & Consent

Google AdMob may process device identifiers (e.g., Advertising ID/IDFA where permitted) to serve and measure ads. In EEA/UK/Switzerland we show a consent message to choose personalized vs non-personalized ads; you can update your choice in the app settings.

iOS Tracking (ATT)

On iOS, we may request permission via Apple App Tracking Transparency (ATT) to enable personalized ads/measurement. If you decline, you will still see ads, but they may be less relevant.
